The impeachment of Warren Hastings (1788–1795) remains the most significant political trial in British history. It was not merely a prosecution of one man, but a philosophical battleground over how Britain should govern its burgeoning Indian empire.

Background and Conflict

Warren Hastings began his career as a clerk and rose to become the first Governor-General of Bengal in 1773. Unlike many of his contemporaries, Hastings was an Orientalist; he respected Indian traditions, learned Persian and Bengali, and believed India should be governed by its own laws rather than European imports.

However, his tenure was marred by constant friction within the Supreme Council of Calcutta.

His primary antagonist, Philip Francis, viewed Hastings’ methods as corrupt and despotic. This personal animosity escalated into a literal duel in 1780, where Hastings wounded Francis. Upon returning to England, Francis dedicated himself to poisoning the reputation of Hastings, eventually finding a powerful ally in the Whig statesman Edmund Burke.

The Charges

In 1787, Burke moved for impeachment in the House of Commons. The prosecution focused on several "high crimes and misdemeanors":

The Rohilla War: Allegations that Hastings "hired out" British troops to the Nawab of Awadh to crush the Rohilla Afghans.

The Execution of Nandakumar: The controversial hanging of a high-ranking official for forgery, seen by critics as a "judicial murder" to protect Hastings from bribery charges.

The Treatment of Raja Chait Singh: Extorting funds from the Raja of Benares to fund company wars.

The Begums of Oudh: The forceful seizure of treasures from the Queen Mothers of Awadh.

The Seven-Year Ordeal

The trial opened in Westminster Hall in February 1788. It became a social spectacle, attended by the elite of London. Burke’s opening oratory was so visceral—describing "rights trodden under foot"—that women in the audience reportedly fainted.

Despite the initial fervor, the trial dragged on for seven years. The defense argued that Hastings’ actions were necessary for the survival of the British presence in India during global conflicts with France and Mysore. Furthermore, Hastings pointed out that he had returned to England with a relatively modest fortune compared to the "Nabobs" who had truly plundered the subcontinent.

Resolution and Legacy

In 1795, the House of Lords finally reached a verdict. Hastings was acquitted on all charges. While legally cleared, the trial left him financially ruined, having spent roughly £70,000 on his defense. The East India Company eventually provided him with a pension to sustain his retirement.

The trial’s legacy was twofold. It signaled to future administrators that they were accountable to Parliament, but it also marked the end of the Orientalist era. By the mid-19th century, the "Anglicist" view—championed by figures like Thomas Macaulay—prevailed, seeking to impose Western education and values on India, a shift that Hastings had spent his career resisting.
